PARTICIPANT ACKNOWLEDGEMENT, WAIVER AND RELEASE

PLEASE READ CAREFULLY before signing this ACKNOWLEDGMENT, WAIVER, and RELEASE FROM LIABILITY (this “AWRL”).

In consideration of my entry acceptance to the SKI DEPOT RAIL JAM by my signature below, I do hereby for myself, my executors, my administrators, my heirs, my next of kin, my successors and assigns or anyone else who might claim or sue on my behalf, fully waive, release and discharge Ski Depot, Inc., any of its subsidiaries, any event sponsors, event directors, event producers, volunteers, all states, cities, counties or localities in which any portion of the Competition is held, and any of such parties respective predecessors, successors, assigns, and past and present shareholders, directors, officers, employees, agents, and representatives (collectively, the “Released Parties”), from any and all claims, losses, or liabilities for death, personal injury, partial or permanent disability, property damage, medical or hospital bills, theft, or damages of any kind (including, without limitation, claims for costs, expenses, and attorneys’ fees) which I may have, or which may hereafter accrue to me as a result of my association with, entry in, or participation in the Competition (the "Released Claims").

I acknowledge that a competition requires a high level of physical fitness and carries with it the potential for death, serious injury, and property loss. I HEREBY ASSUME THE RISK OF PARTICIPATING IN THE COMPETITION. I certify that I am physically fit, have sufficient skills to participate in the Competition, have sufficiently trained for participation in the Competition, and have not been advised against participation by a qualified health professional. I acknowledge that my statements on this AWRL are being relied upon by Ski Depot, Inc. and the various event sponsors, organizers and administrators in permitting me to participate in the Competition. I also assume any and all other risks associated with participating in the Competition including but not limited to falls, contact and/or effects with other participants, effects of weather including heat and humidity, defective equipment, water hazards, marine life hazards, contact with boats, and any hazard that may be posed by spectators or volunteers. All such risks being known and appreciated by me, I further acknowledge that these risks that may be the result of negligence of the Released Parties.

I AGREE to refrain from directly or indirectly asserting any claim or demand or commencing (or causing to be commenced) any suit, action, or proceeding of any kind, in any court or before any tribunal, against any of the Released Parties for any of the claims, losses, or liabilities that I have waived, released, or discharged herein. I HEREBY AGREE to indemnify and hold harmless the Released Parties from any claims made or liabilities assessed against them, including attorneys’ fees, as a result of (i) my actions or inactions, (ii) the actions, inactions, or negligence of the Released Parties including those parties hereby indemnified, and (iii) the conditions of the facility, equipment, or areas where the Competition is being conducted.

If any provision of this AWRL shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this AWRL and shall not affect the validity and enforceability of any remaining provisions.

In the event you are under 18 years of age, your parent or guardian must complete the following on your behalf:

I represent that I am the parent/guardian of the child named below, who is under 18 years of age. In consideration for allowing my child/ward to participate in the Competition, I hereby consent to the foregoing AWRL on my own behalf and on behalf of my child/ward, his or her executors, administrators, heirs, next of kin, successors and assigns or anyone else who might claim or sue on behalf of my child/ward. I hereby agree to indemnify and hold harmless the Released Parties from any Released Claims made or assessed against them by me or by any other party, including with out limitation by my child/ward subsequent to his or her reaching majority, including reasonable attorney’s fees. I also certify that my child/ward is physically fit, has sufficient skills to participate in the Competition, has sufficiently trained for participation in the Competition, and has not been advised against participation by a qualified health professional.
